PorchQ Terms of Service

These Terms of Service explain the rules that govern your use of PorchQ's HOA management platform. Please review them carefully. If you have questions, contact us at support@porchq.com.

Introduction

These Terms of Service (“Terms”) govern your access to and use of the PorchQ homeowners association (“HOA”) management workspace, applications, APIs, and related services (collectively, the “Service”).

By creating or funding an account, or by using any portion of the Service, you agree to these Terms on behalf of the HOA, management company, or organization you represent. If you do not agree, do not use the Service.

Accounts & Eligibility

You must be at least 18 years old and authorized to bind your HOA or company to these Terms. Account owners are responsible for keeping login credentials confidential and ensuring their users comply with these Terms.

Administrators may invite board members, managers, residents, and other stakeholders to the Service. You are responsible for the accuracy of user information and for promptly revoking access when an individual should no longer use the Service.

Pay-As-You-Go Usage & Billing

A PorchQ account has no monthly platform subscription, minimum spend, or per-community fee. Published metered services draw from a dollar-denominated PorchQ balance at the rate shown when the service is used.

You authorize PorchQ or its payment processor to charge the amount you confirm when adding funds. If you separately enable optional auto-reload, you authorize charges only under the threshold and reload rule you configure. Auto-reload can be disabled at any time and is not a subscription.

  • Purchased funds and promotional credit are tracked separately and may have different refund, eligibility, or expiration terms.
  • Rates may change prospectively; historical usage retains the rate that applied when it occurred.
  • Insufficient funds may pause new metered services, but do not disable free account access or existing data.
  • Any legacy subscription remains governed by its applicable agreement until PorchQ and the customer explicitly migrate it.

Acceptable Use

You agree not to misuse the Service or assist anyone else in doing so. Prohibited activities include, without limitation:

  • Attempting to gain unauthorized access to systems, networks, or data.
  • Transmitting malware, phishing content, or other harmful code.
  • Using the Service to violate privacy, housing, consumer protection, or other applicable laws.
  • Ingesting content that infringes intellectual property rights or contains unlawful material.

Data Ownership & Privacy

You retain ownership of the data, documents, and other materials you upload to the Service. By submitting data, you grant PorchQ a non-exclusive license to store, process, and transmit that data solely for the purpose of providing the Service.

PorchQ’s collection and use of personal information is described in our Privacy Policy. You are responsible for ensuring you have the necessary rights and consents to share resident or homeowner information with PorchQ.

Support & Availability

PorchQ provides email support through support@porchq.com. We aim for high availability but do not guarantee the Service will be free from interruptions or errors.

Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, PorchQ disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, PorchQ’s total liability for claims arising out of or relating to the Service is limited to the amount you paid for the Service during the 12 months preceding the event giving rise to the claim.

Termination

You may stop using the Service or request account closure by contacting support@porchq.com. PorchQ may suspend metered services or terminate access if you violate these Terms, reverse funded value after it is used, or if continued service would create legal or security risk. Financial and usage history may be retained where required for audit, accounting, fraud prevention, or law.

General Terms

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Disputes will be resolved exclusively in the state or federal courts located in San Francisco County, California.

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes become effective constitutes acceptance of the revised Terms.

For questions about these Terms, contact us at support@porchq.com.
